These Terms apply to use of the Spottedfern Creations website and to orders placed through the store. By using the website or placing an order, you agree to these Terms to the extent permitted by law.
Store and products
Spottedfern Creations is an Australian artist store offering artwork, handmade creations, merchandise and commissioned work. Product descriptions, images, dimensions, materials and other details are provided as accurately as reasonably possible.
Handmade items and original artwork can contain small variations that are part of their handmade nature. Colours can also appear differently between screens. These variations do not affect any rights you may have where goods fail an applicable consumer guarantee.
Prices and orders
Prices are shown in Australian dollars (AUD) unless stated otherwise. Shipping charges and any other applicable amounts are shown before checkout where relevant.
Orders are subject to product availability and successful payment. We may contact you if an item is unavailable, an obvious pricing or listing error has occurred, or additional information is reasonably required to fulfil the order. One-off originals and limited handmade pieces may have only one unit available.
Payments
Payments are processed through Shopify and the payment methods made available at checkout. Payment providers may apply their own terms and privacy practices.
Commissions and custom work
The scope, price and expected timeframe for commissioned or custom work are agreed individually because they depend on the requested piece and its complexity. Any deposit, revision, approval or cancellation arrangements that apply to a commission will be communicated and agreed as part of that commission.
Customers are responsible for supplying accurate instructions and, where they provide photographs or other reference material, for ensuring they have the right to provide and use that material for the requested commission.
Copyright and artwork
Unless expressly agreed otherwise in writing, copyright and other intellectual property rights in artwork, designs, photographs, illustrations and other original content created by Spottedfern Creations remain with their creator. Purchasing an original artwork, print, handmade item or commission does not by itself transfer copyright or grant a right to reproduce, distribute or commercially exploit the artwork.
Content on this website must not be copied, reproduced, sold or used commercially without permission, except where permitted by law.
Shipping, returns and refunds
Shipping and delivery are governed by our Delivery & Shipping page. Returns, remedies and refunds are governed by our Returns & Refunds page and applicable law.
Third-party services and links
The website may contain links to third-party websites or use services provided by third parties, including Shopify, payment providers and social platforms. Those third parties may have their own terms and privacy practices.
Consumer rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
Changes to these Terms
We may update these Terms when the store, services or applicable requirements change. The current version will be published on this website with an updated date.
